Welcome to Plant Identifier, the intelligent plant identification and care management application developed by Marberx Technologies Pvt Ltd. These Terms of Service ("Agreement") establish the legal framework governing your use of the Plant Identifier mobile application and associated services.

Important Notice: By downloading, installing, or using Plant Identifier, you acknowledge that you have read, understood, and agree to be legally bound by this Agreement. If you do not agree, you must cease using the application and uninstall it.

Article 1: Application Overview and Service Description

Features: AI-powered plant ID, care schedules, botanical database, community sharing, weather integration, pest & disease recommendations.
Availability: iOS and Android via app stores, features may vary by region.
Updates: Regular releases for improvements and security.

Article 2: User Eligibility and Registration

Age 13+, under 18 require guardian consent.
Accounts created automatically per device. Premium allows cross-device sync.
Users are responsible for account security and must report suspicious activity.

Article 3: Subscription Plans & Payments

Free, Premium Monthly, Premium Annual, Family Plans.
Billed via app stores. Prices subject to change.
Cancel anytime via app store. Refunds per store policy.

Article 4: User Conduct & Content

Personal, non-commercial use only. No reverse engineering or illegal use.
Respect intellectual property rights.
Content submitted grants Marberx perpetual, royalty-free, worldwide license for AI training, improvements, promotions.
Users warrant they have rights to submitted content.

Article 5: Data Privacy & Security

Collected: device info, usage patterns, location (opt-in), photos, care schedules.
Usage: plant ID, recommendations, service improvements, fraud prevention.
Security: encryption, secure transmission, audits. (See Privacy Policy)

Article 6: Intellectual Property

Owned by Marberx: software, AI models, database, trademarks, UI/UX.
License: limited, non-transferable, for personal use only.
Third-party licensed content remains protected.

Article 7: Limitations & Disclaimers

No guarantee of uninterrupted service.
Plant ID results may not be 100% accurate; verify critical IDs independently.
Not a substitute for professional botanical or medical advice.
Care advice is general and must be adapted to individual conditions.

Article 8: Liability & Indemnification

Not liable for indirect, incidental, consequential damages.
Liability limited to Premium fees paid in last 12 months.
Users indemnify Marberx for misuse or violations.
No liability for force majeure events.

Article 9: Modifications & Termination

We may update terms with notice; continued use = acceptance.
Users may terminate by uninstalling; Marberx may terminate for violations.
Service may be discontinued with 60 days notice.
Termination ends Premium access; users must export data before deletion.

Article 10: Miscellaneous

This Agreement + Privacy Policy = full agreement.
If any part is invalid, remainder stays valid.
Users cannot assign rights; Marberx may assign to affiliates.
No waiver unless explicitly stated.
